What Are the Different Types of Courts-Martial?
According to the Uniform Code of Military Justice (UCMJ), there are three different kinds of courts-martial: summary, special, and general. A court-martial is comparable to a civilian criminal trial and is intended to try all military offenses. The offense you are accused of determines which court-martial you will be tried under.
Each court-martial is characterized by the following:
- Summary Court-Martial: Typically reserved for minor incidents of misconduct; punishment can include confinement and forfeiture of pay.
- Special Court-Martial: Seen as the intermediate court level and includes both a prosecutor and a defense attorney; punishment can include confinement, forfeiture of pay, and a bad conduct discharge.
- General Court-Martial: The most serious criminal trial and often characterized as felony court; punishment can include confinement, discharge, or even death.
As the defendant, you are entitled to your own defense counsel throughout the courts-martial. Your attorney is responsible for presenting evidence to combat your charges and pursuing a reduced or dismissed sentence. The importance of strong defense counsel cannot be overestimated.
